Bankruptcy is a FEDERAL law, not a state law. Bankruptcy petitions are filed in Federal Bankruptcy Courts within the Federal District (geographical) in which the debtor has resided for the last six months (there are some "wierd" exceptions).
Most consumers (people NOT in business) file either for a "Chapter 7" [a straight liquidation] or a "Chapter 13" [ the so-called 'wage-earner plan'].
Married people can file alone or together (single or joint). If a married couple file a joint petition they both go bankrupt for the same single court cost.
Filing costs for the Eastern District of Louisiana currently run about $200.00.
Most debtors hire a lawyer. I recommend hiring a lawyer. The lawyer can explain many things to you, advise you in pre-bankruptcy financial planning, point out exemptions you may be qualified for, and accompany you to any meeting(s) with the trustee and/or creditors.
You will be REQUIRED to file paperwork in Federal Court that meets certain specific requirements as to content and in a specific order. You (or your lawyer, which I recommend) will have to prepare this paperwork based upon information you supply.
You, or your lawyer, send me the completed QUESTIONNAIRE along with $90.00*, and I send back a completed packet of paperwork ready for signature and filing in Bankruptcy Court.
*- This assumes that: 1) Twenty-five creditors or less [each creditor in excess of 25 is an additional $2.00 each]; 2) Only one real estate property description [each real property description in excess of one is an additional $5.00 each]; 3) This is a consumer bankruptcy either Chapter 7 or Chapter 13. ADD apppropriate amount to the initial $80.00 and send the entire amount.
Print out the questionnaire, photocopy whatever extra pages you need to copy, you (and your lawyer) fill out the questionnaire, make a photocopy of the completed questionnaire, send me the photocopy of the questionnaire, along with the appropriate amount of money.
I will send you back a completed petition, with schedules, within five working days of my receipt of the properly filled out and pre-paid questionnaire. IF YOU SEND ME A CHECK IT WILL TAKE LONGER because I will wait for your check to clear before I start work. Send me a MONEY ORDER or a CASHIER'S CHECK.
